These Terms of Service ("Terms") govern your use of the website topsailbiz.com ("Site") operated by Topsail Area Local Businesses ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms.
Use of the Directory
Our business directory is provided for informational purposes. We compile information about local businesses from public sources and user submissions. While we strive for accuracy, we cannot guarantee that all business information (hours, phone numbers, addresses, etc.) is current or correct.
- You may use the directory to find local businesses, read reviews, and contact businesses directly.
- You may not scrape, crawl, or bulk-download directory data for commercial purposes without our written permission.
- You may not use automated tools to submit fake reviews, spam businesses, or manipulate listings.
Business Listings
Business information in our directory is compiled from publicly available sources including Google Places, OpenStreetMap, and direct submissions. If you are a business owner:
- You may claim your listing to update your information at no cost.
- We reserve the right to include any business that operates in our coverage area.
- If you want your business removed from the directory, contact us at hello@topsailbiz.com and we will remove it within 7 business days.
Reviews
Users may submit reviews for businesses listed in our directory. By submitting a review, you agree that:
- Your review reflects your genuine experience with the business.
- Your review does not contain false, misleading, defamatory, or fraudulent statements.
- Your review does not contain profanity, hate speech, personal attacks, or spam.
- Your review does not contain links, advertisements, or promotional content.
- We may display your review publicly on the business listing page.
- We reserve the right to remove any review that violates these guidelines or that we determine to be spam, fraudulent, or inappropriate.
User Accounts
You may create an account to claim a business listing, post events, or manage your business profile. By creating an account, you agree that:
- You will provide accurate information during registration.
- You are responsible for keeping your login credentials secure.
- You will not create accounts for businesses you do not own or operate.
- We may suspend or remove accounts that violate these Terms.
Event Posting
Claimed businesses and community members may post events (food truck pop-ups, live music, yard sales, church dinners, etc.) to our events calendar. By posting an event, you agree that:
- Your event information is accurate and you have authority to post it.
- Events must take place within our coverage area (Topsail Island and surrounding towns).
- Events may not promote illegal activity, hate speech, or adult content.
- We may remove events that violate these guidelines or appear to be spam.
Free and Paid Event Posting
- Free tier: Every business and community member may post 1 event per calendar month at no cost.
- Subscription tier ($49/month): Subscribers may post up to 5 events per calendar month.
- If another business lists your business in their event (for example, a brewery listing a food truck), that counts against your free posting quota, not theirs.
- If you cancel your subscription, future events beyond your cancellation date that exceed the free tier allowance will be removed.
Subscriptions and Payments
Paid subscriptions are billed monthly through our payment processor (Authorize.net). By subscribing, you agree that:
- You authorize recurring monthly charges to the payment method you provide.
- Subscription pricing may change with 30 days' notice sent to your account email.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us at hello@topsailbiz.com for refund requests.
Email Notifications
You may opt in to email notifications including weekly digests, weekend previews, and alerts when businesses you follow post new events. By subscribing to notifications:
- You consent to receive emails at the frequency you select during onboarding or in your account settings.
- You may unsubscribe from individual notification types or all notifications at any time using the links in each email or through your account settings.
- We will not send marketing emails unrelated to the notification preferences you selected.
Video Marketing Services
We offer paid video marketing services for local businesses. These services are subject to separate agreements made directly between us and the business. Pricing, deliverables, and timelines are discussed on a per-project basis.
Intellectual Property
The Site design, logo, original content, and code are owned by Topsail Area Local Businesses. Business information, photos sourced from Google Places, and user-submitted reviews remain the property of their respective owners.
Disclaimer
The Site is provided "as is" without warranties of any kind, express or implied. We are not responsible for:
- The accuracy, completeness, or timeliness of business information
- The quality of products or services offered by listed businesses
- Any transactions between you and businesses found through our directory
- The content of user-submitted reviews
- Any losses or damages resulting from your use of the Site
Limitation of Liability
To the fullest extent permitted by law, Topsail Area Local Businesses shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site.
Existing Users
If you had an account before these updated Terms took effect (March 18, 2026), you are not required to retroactively agree to the new event posting or notification terms. Those sections apply when you first use the relevant features (posting an event, subscribing to notifications, etc.).
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of North Carolina, United States.
